The office of Lydia Meyer handles Chapter 13 cases for the Northern District of Illinois, Western Division. The Western Division includes, Jo Daviess, Stephenson, Whiteside, Lee, Winnebago, DeKalb, McHenry, Ogle, Carroll and Boone Counties.

The Trustee's office is responsible for administering Chapter 13 Plans. This includes many aspects of receiving and monitoring all Chapter 13 cases in this area. The Trustee's office is responsible for collecting debtor payments and issuing checks to their various creditors as required by their chapter 13 plan.

Chapter 13 is one method under the Bankruptcy Code to obtain relief from creditors. It allows a debtor to propose a fair plan to pay back their creditors. Chapter 13 allows debtors to keep most of their property during the time they are paying back their creditors. A debtor may be able to modify some of their contract payments, interest rates and lengths of obligations to their creditors. In general, creditors cannot take action against a debtor until they have been to court and the Judge allows the creditors to take action against the debtor.

In a Chapter 13, the debtor agrees to pay a portion of their income into their plan (through the Trustee’s office) over a period of 36-60 months. These funds are used to pay creditors money owed to them by the debtor.

 

It has come to the attention of the Trustee's office that a possible scam is being perpetrated on some Chapter 13 debtors.  The Chapter 13 debtor is contacted by telephone, text or email by someone who claims to be calling from the Trustee's office.  The person calling demands that the debtor make an immediate payment.

The Trustee's office will NEVER contact a debtor by telephone, text or email and demand a payment.  All payments must be made through TFS or be mailed to the Trustee at P.O. Box 190, Memphis, TN  38101-0190.  Your Chapter 13 Plan payment should not be mailed to any other address or made in any other form.  If this address changes, debtors will be advised in writing and the address change would be posted on this website.
